i recently went off a debt management program. Citibank agreed to 9.99% interest rate and $115.00 a month, which was more than the original minimum payment. Now we are off the plan (one month now), they have sent our remaining balance ($1,300.00) to a collection agency. Do I have recourse?
If your creditor does not receive the payments on time, then he has the rights to charge off the account and assign it to a collection agency. The collection agency can in turn contact you for the debts. You can contact your creditor and ask them to withdraw the account from collections. However, it will be the discretion of the creditor whether or not he will consider your request.
