hello, Iam have been divorced for 4 yrs. Me and my ex have about 75,000. in debt. plus we had two forclosures. creditors are garnishing both of our wages and others are waiting. My ex husband is paying childsupport and he owes irs. can we still file bankrupsy together? I by court was obligated to pay 4 of our credit bills, which equals about 7000.00 should i just worry about my debt since we divorced but i worry everything else is under my name too, would like to clear everything up is bankkrupcy the best option since i dont have money to offer settlements and they are garnishing my wages? Would this allow him to stop paying childsupport? or can we even file together since we are divorced? Help//

SInce you are no longer married, you would need to file bankruptcy seperately. 

 

Filing bankruptcy does not affect child support, meaning he would have to keep paying that.

As far as I can understand, you may be liable for paying those debts which are under your name. If you're filing bankruptcy, then you can include all your debts. As far as child support is concerned, I don't think you're ex will be able to stop it because it is ordered by the court. To know whether or not you can file bankruptcy jointly, you need to contact a bankruptcy attorney and take his/her opinion in this matter.
