Shall I file a lawsuit against my ex-husband?

I have separated from my husband 5 years ago. I have taken every step to pay off my debts in the last few years in the hope of obtaining a favorable mortgage deal. I checked my credit report recently and found that my credit score has dropped by 50 points. I saw that I owe around $45,000 on a credit card.

My ex-husband has accrued the debts on an old credit card. I was the joint account holder. I have even forgotten about it. My ex-husband has used the credit card without informing me. I have not used the card after my divorce. Am I accountable for the debt? What step should I take now? Shall I file a lawsuit against my ex-husband?

Yes, I am a divorced woman right now. It was written in the divorce decree that I won't be held responsible for his debts henceforth.

On what grounds would you sue him?  The credit line and debt is just as much his as yours!

Are you now divorced?  If so, was there anything in the divorce decree concerning debts?
