I was served back in May and I tried to work with the debt collection agency but they said, "you have no job, you have no money, I can't help you. I suggest you get an attorney to represent you in court." Well, I can't afford one and legal aid just does not cut it. However, instead of just letting them have a default judgement, I did answer the lawsuit and went to the court house to submit my answer to the claim. I told the courts that according to the Texas SL that the time may have passed for them to legally be able to see me sue me since the Texas SL is 4 years, and the debt was never paid on and is 8 years old. I have not gotten a court date yet or heard anything as of yet. My question is if you cant afford an attorney & the debt agency is like see you in court- then will the judge consider my answer that the debt is over 8 years old and have not been paid on? Thank you. I thought that they were never supposed to sue me in the first place but since they have will the judge consider my answer or will he admit the case anyway? I dont have a dime for them and they are not even the original creditors and are like the third or fourth person to get the loan.
