Check the court dockets.  Midland has a history of sewer service, meaning they "serve" you at a wrong address.   If you were not served, you can have the judgemnet set aside for lack of service.

Hi photogirl,

Didn't you receive a summons from the court? Unless the creditor files a lawsuit and gets a judgment from the court, he won't be able to garnish your wages. If the creditor files a lawsuit, then you should be receiving a summons from the court. It's quite surprising that you had no knowledge about the lawsuit filed aganst you. You should contact Midland Funding and clarify the whole matter. In case, you're unable to deal with them on your own, then you may take the help of an attorney.

Take care.

As I'm not a lawyer, I believe that "A lean compromise is better than a fat lawsuit". :)
