I am being sued by LVNV Funding, LLC. They refuse

I am being sued by LVNV Funding, LLC. They refused my attorney's offer to settle the account. My trial date is the 29th of this month. I live in Missouri. Can you please explain to me what happens at the trial? Will I have to pay anything that day, or is it possible to go to jail or anything?

No you won't jail. Matter of fact they hope you don't show that way will be a easy win for them. But when you get there just tell the judge you can only afford what you can month let's say $50 and LVNV refuse it in the past. The judge will oder them to accept it or they won't paid who walks into court with all the money they're sueing you for. And in some cases they don't show because most of the time we don't go because we figure we're going to lose anyway so therefore forget it. But when you show and they don't you win and the case is dismiss you don't owe them nothing. Yes they might try and sue you again just keep your dismiss papers maybe the next judge will rule in your favor they didn't show the first time. In the fulture just pay something $10 or $50 on any debt you might so when they try to sue you have proof you've paying on it.

 


Rae my boyfriend was just served papers by a sheriff today saying that he has been sued. We were not aware of any court date or that anything was going on. He also has no idea where the debt came from. Possibly his ex wife opened an account in his name. Please keep us posted on your case. Thanks

Have you been able to validate the debt they claim is yours?? I am in the process of suing LVNV for harassment and deflemation of charater. They are trying to collect a debt that is not mine I don't even know who it belongs to I have obtain California state records to prove this. They have also harassed my mother and sent me multiple names addresses and phone numbers of other people who owe them debt? This company practices illegal collections within the state of California.

This is a civil matter - jail is a criminal matter and not something a judge could order in a civil case (unless you misbehave in court and are found in contempt), but not as an outcome to the issue at hand. Best of luck!

Make sure you're present at the court on 29th of this month. Carry importnant documents with you. You won't go to jail even if you lose the case. Your attorney should be able to clarify all the details.
