Hello. I have received a summons for an unpaid credit card debt (amount $6850). I filed an answer before the return date and have been given a court date in 3 weeks. The week before last I phoned the collection agency to try to settle; they offered $4500 but said they were going to court "regardless". I want to avoid judgement at all costs. I have had a legal aid entity review the summons and they state I could try to delay, requesting they prove the debt, debt amount, etc. I really don't want to go to court but need to get this taken care of. This is my only blemish on my record; I am a homeowner. What do you suggest? Do I write the collection agency and try to counter settle with a lower offer? Or do you think they will go to court? What does your experience tell me to do in my situation? Thank you

You should file an answer too. Call the CA and start negotiating for a settlement. Remember, you don't have much time. At this moment, I don't think they will agree to settle the debt below $4500

Hi there and thank you. Actually I filed an appearance not an answer, if that makes a difference. I am looking on this website for guidance on a range that I could start with for settlement and also what could be realistic. Thank you

You need to call for a settlement, skip the letter writing. Get the settlement offer IN WRITING.  Pay it with certified funds.  Show up in court with a copy of the settlement offer and receipt for payment. 

 

At this point, they have nothing to loose and everything to gain by getting a judgment against you.
