Capital One is suing me. I'm not sure, but I think the statute of limitations is up or close to it. However, I have no job, property or bank account. I have no money. I need to know what I should do. I have a year old child to raise and my husband makes almost nothing for pay. What do I do?

How do you know that Capital One is suing you? Have you been served summons? They can sue you even if the SOL period has expired. You'll have to tell judge that the debt is time barred.

You need to figure out when the date of your last payment was to determine if the debt is within SOL or not.

Have you thought of getting a job when your husband is at home to look after your child?  Nights, weekends???
