You should contact with the Office of the State Bank Commissioner in order to know whether or not pdl companies are licensed in your state. Their contact detail is as follows:

If you find that the lenders are licensed, then they can sue your son because of non-payment of debt. On the other hand, illegal lenders won’t be able to take any legal action against your son.

Does Kansas distinguish between online and bricks and mortar payday loans?  I looked up whether or not payday loans are legal in Kansas and they are.  Do they differentiate between the two, and are most online payday lenders usually illegal?

A majority of these online pdls are operating illegally, so you need to careful while applying for such loans.

You won't go to jail for being overdue on your loan. You can be sued if the business is legitimate. In case they achieve a judgment against you, they might gain access to your bank account.

Without knowing the name of the lender, we cannot tell you if they are legal or illegal.  A legal lender COULD sue ...an illegal cannot.

Thanks Soaplady.  I wish I had more info.  I mainly need to find out whether or not online payday loans are legit or not?  It would seem to me with all the websites (pages) that one has to go thru to get the loan (third party)  that it seems like a shady type of deal, these online companies.

I'll have to find out.  He doesn't want me worrying about it.  I forgot to ask him. When I talk to him later on in the week, I will get the name.  I believe they sent it to a debt collector however.
