Can I request a DV after being sued by Portfolio Recovery; and start that process - or is it too late?

Have you already been sued? If so ignore the crap above. If you have already been sued, it means that you (hopefully) were serve and had your day in court. So the answer is no. You should have requested proof of the debt when responding to the summons or asked for during discovery.
