i had a loan from plain green that i couldn't afford.  i asked for lower payments, refinance or just paying the prinicipal.  they denied all options so i closed my account and ignored phone calls and emails.  about 90 days later they send me an email:

You have failed to satisfy your outstanding debt on your Plain Green

i replied back:

The state of NC has deemed payday loans illegal.  I ask that you
> please stop efforts collect on the loan. If further attempts to

> for the NC Attorney Generals office as recommended by the NC
> Department of Justice.

afterwhich they sent me another email:

Late payments, missed payments, or other defaults on your account may be reflected in your credit report.

Dear Ms. Murphy,

Your correspondence has been directed to me for review and I thank you for the opportunity to assist you at this time.

We understand that all situations are different and would like to offer you the opportunity to pay the remaining principal in the amount of $775.42. We propose the following payment plan:

May 4, 2012 $129.23
June 4, 2012 $129.23
July 4, 2012 $129.23
August 4, 2012 $129.23
September 4, 2012 $129.23
October 4, 2012 $129.27

To further clarify your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa-Cree Tribe of the Rocky Boy’s Indian Reservation of Montana (“Chippewa-Cree”). Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an “Arm of the Tribe,” in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is not a payday loan.

This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.

Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.

Please reply to this email if you accept this offer to settle your account.

If your state has laws against high interest rates, as many states have now, just information them that you know your rights and all of a sudden you won't have to pay interest and they are willing to make payment arrangements with you.

I have done tons of research online about payday loans.  A few sites mention that Plain green loans are illegal because they are not licensed by a state since they are an indian tribe. Because they are illegal you only have to pay back the pricipal.  I just spoke to plain green and told them to remove my automatic debit payments and asked for a payment schedule.  I also told them I know that they are a tribe and not registered with a state so my rights state I only have to pay back the priciple not the apr or interest rates.  The guy told me that I do have to pay back all the loan on the schedule provided because I signed the loan agreement online and that agreement states the truth in lending.  does anyone know anything about this.  I received $1,000 and already paid back $721 because of interest and I still have 5 months of payments to make.  So after its all said and done I will have paid $1923.36 for $1,000 loan.  I need help in clearing this without paying all this interest,.  Anyone know how?

Most of the companies are illegal. As such you are only required to pay the principal amount. If you have already paid off the principal amount, then ask for a refund. You won't be criminally prosecuted for closing the accounts. It is a myth.

Ok what does BVI mean and what about CAshCUre

Should i just send principal to illegal one or what

PLain green loans...tribal loan....illegal

CAsh CUre

Cash Call...looks like a loan company, not a PDL

Magnum Cash Advance...looks like based in BVI

You cannot be criminally prosecuted....debts are civil, not criminal.  Close your bank account asap and negotiate directly.
