Can payday loan companies garnish my wages? I have been threatened on phone that they are going to garnish my wages.

I have a $500.00 loan at Cash Express in Ky.  I could not pay the loan back and ask if they would take payments.  They told me no and that their corporate office is taking me to small claims court and will garnish my wages 12%.  Can they do that  Thanks Judy

Yes this was an internet loan and their name is cash net


Can you tell me about Cash Yes and Ace Cash Express in the State of Texas?  Can they garnish your wages or just try the voluntary wage assignment

Threatening to take me to court and all sorts of other bad actions

I supposedly took a loan out over the internet.

 

I just want to make sure this person is legitimate.  They do have a website.

 

They say they are licensed in Wisconsin.  I live in Minnesota.


I live in Minnesota and only a few payday lenders are legal here.  I took a loan out with EZpayday cash and they are not licensed here.  Can they take me to court for non-payment of my loan?  I have paid off the original amount borrowed but now they want me to pay the interest.


What about the state of Utah?


You haven’t mentioned the name of your state and the name of pdl companies. So it’s very difficult to say whether or not the pdl companies are licensed in your state. Legal lenders can file a lawsuit against you because of non-payment of debt. Once the court issues a judgment against you, then they can garnish your wages. On the other hand, illegal lenders won’t be able to take any legal action against you.


I agree with what Ohio has said. One can't garnish your wages within a few hours. The pdl company has to file a case first. If they win the case and the court issues judgment against you, then your wages can be garnished. Moreover, if garnishment is not allowed in your state, then the pdl company won't be able to garnish your wages. Check the state wage garnishment laws in your state.
